How Oil and Gas Regulatory Compliance Works in Texas

The RRC also administers the Oil and Gas Division’s enforcement program, which includes penalties for violations of state regulations and conditions attached to permits.

Texas Commission on Environmental Quality (TCEQ)

The TCEQ has jurisdiction over air quality, water quality, and waste management across Texas, including the oil and gas sector. For operators, TCEQ compliance centers heavily on air emissions.

Oil and gas facilities are significant sources of volatile organic compounds, nitrogen oxides, hydrogen sulfide, and other regulated air pollutants. The permitting requirements for these emissions depend on the size and type of operation, the specific equipment in use, and the geographic location relative to ozone nonattainment areas.

TCEQ offers multiple permit pathways, standard permits, permits by rule, and flexible permits, each with different requirements and suitability for different operations. Understanding which pathway applies and whether an operation qualifies to use it is a technical determination with real enforcement consequences if made incorrectly.

Federal Oversight: EPA and Beyond

Federal environmental regulations layer on top of state requirements for many Texas operators. EPA’s New Source Performance Standards under 40 CFR Part 60 Subpart OOOOa and OOOOb set emission standards for oil and gas production and processing equipment. The National Emission Standards for Hazardous Air Pollutants establish separate requirements for operations that emit hazardous air pollutants above specified thresholds.

Operators with federal mineral leases face additional obligations under Bureau of Land Management regulations. Operators who cross state lines or operate on navigable waterways are subject to federal jurisdiction under the Clean Water Act and related statutes.

Operations change over time, new equipment is added, production volumes increase, and operational procedures are modified. When those changes aren’t reflected in updated permit authorizations, operators may unknowingly operate outside the scope of their existing permits.

Permit gaps are among the most common compliance findings in RRC and TCEQ inspections. They’re also among the most avoidable when operators have a systematic process for tracking operational changes against existing permit conditions.

Emission Calculation Errors

Air emission calculations for oil and gas operations are technically complex. They depend on equipment specifications, operational parameters, emission factors, and, in some cases, stack testing results. Errors in these calculations, even in good faith, can result in underreported emissions that trigger enforcement action when discovered during an inspection or audit.

The move toward more sophisticated air monitoring technology is increasing the likelihood that calculation errors will be identified. Operators who rely on outdated methodologies or haven’t reviewed their calculations against current guidance face increasing exposure.

Recordkeeping and Reporting Deficiencies

Many compliance requirements come with recordkeeping and reporting obligations that are as important as the underlying operational requirements. Operators who meet the operational standards but cannot demonstrate compliance with adequate records face the same enforcement exposure as operators with actual violations.

Annual compliance certifications, monthly production reports, emission inventory submittals, and inspection logs all create a paper trail that regulators examine closely. Missing records, inconsistent data, or reports that don’t reconcile with operational reality are red flags that trigger further scrutiny.

Regulations governing oil and gas operations in Texas have been among the most actively evolving in the country over the past decade. Methane emission rules at the federal level have changed multiple times as administrations have shifted. TCEQ has updated air permitting guidance and enforcement priorities. That means regular internal audits against current permit conditions and regulatory requirements; a process for tracking operational changes against permit authorizations; current and accurate emission calculations maintained by qualified personnel; complete and organized records that can withstand inspection; and a relationship with compliance consultants who stay current on regulatory developments.

Compliance failures are rarely the result of operators who don’t care about compliance. They’re the result of operations that have grown faster than the compliance infrastructure supporting them, or programs that were adequate when they were built but haven’t kept pace with regulatory changes.
